5th Annual EatingWell Holiday Cookie Contest - Official Contest and Sweepstakes Rules

EATINGWELL OFFICIAL CONTEST AND SWEEPSTAKES RULES

These rules apply to the EatingWell Cookie Contest, the Bakers’ Choice Contest and the EatingWell Bakers’ Choice Sweepstakes.

NO PURCHASE NECESSARY. THIS CONTEST IS GOVERNED BY THE LAWS OF THE STATE OF VERMONT. VOID WHERE PROHIBITED. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

ELIGIBILITY: Open to residents of the United States and the District of Columbia only, who are 18 years of age or older as of October 15, 2009. Employees, officers or directors of Eating Well, Inc., Cooking.com and Organic Valley and/or their respective affiliates, subsidiaries, parent and related companies, agencies, and individuals living in the same household (whether or not related) or immediate families (spouses, parents, children and siblings, regardless of where they live) of such employees, officers and directors are not eligible. All taxes, if any, are the sole responsibility of the winner.

Previous grand-prize EatingWell Holiday Cookie Contest winners are ineligible to win the grand prize in 2009. Food professionals, such as chefs, food writers or recipe developers who create recipes for pay are ineligible to win a prize.

HOW TO ENTER CONTEST: Recipes must be original. EatingWell will disqualify any recipe that has been previously published.

Once your entry is received, you will be entered and eligible to win a prize. Entries will not be returned.

ENTRY DEADLINE/RECEIPT: Recipe entries must be submitted or postmarked by June 1, 2009. All sweepstakes entries must be received by 12:00 midnight EST on December 15, 2009. Only entries actually received by EatingWell or Cooking.com will be entered. “Received” means actually delivered to EatingWell or Cooking.com  by the U.S. Postal Service or another delivery service or, for online entries, when EatingWell’s or Cooking.com’s servers record the entry information. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by EatingWell of an entry for purposes of these Official Rules. In the event of a dispute about the identity of an online entrant, each online entry will be declared made by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet Access Provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the winning entry is an online entry, the potential winner may be required to provide proof that s/he is the authorized account holder of the email address associated with the winning entry.

PRIZES: The grand-prize winner will receive a $2000 “Baker’s Dream Kitchen” gift certificate from Cooking.com and a year’s worth of organic dairy products from Organic Valley (over $700 value). Five runners-up each will receive a $200 gift certificate from Cooking.com. Plus, each of the six finalists will receive EatingWell Comfort Foods Made Healthy: The Classic Makeover Cookbook, EatingWell in Season: The Farmers’ Market Cookbook, a year’s subscription to EatingWell Magazine and an EatingWell wall calendar.

One Bakers' Choice winner will receive a $200 gift certificate from Cooking.com and $200 in coupons for organic dairy products from Organic Valley. One randomly selected Bakers’ Choice Sweepstakes winner (selected from the pool of Bakers' Choice voters who entered their e-mail addresses) will receive a stand mixer of their choice from Cooking.com (up to retail value of $550) and 50 voters will receive free coupon booklets for organic milk, eggs and other products from Organic Valley ($10 value).

Acceptance of the prize or parts thereof constitutes permission (except where prohibited by law) to use the winner’s name, likeness, and statements for publicity purposes without additional compensation or limitation. Cooking.com is not bound to replace any lost or stolen prize items. Any expenses not specifically stated are the sole responsibility of the winner.

Gift certificates from Cooking.com are redeemable for merchandise only at Cooking.com. Any unused balance on the gift certificates will be available for future purchases under the same gift certificate number. Gift certificates are not refundable, cannot be used to purchase other certificates and have no cash value. Gift certificates cannot be applied to previous purchases. Coupons from Organic Valley are good only in USA on purchase of brand/size indicated. Void if copied, transferred, prohibited or regulated.

SELECTION: EatingWell Magazine editors will judge original recipes on healthfulness, creativity, taste and practicality. Practicality will be based on efficiency, ease of preparation, expense and availability of ingredients and supplies, among other factors. Decisions of the EatingWell judges are final and may not be appealed. Winners will be selected by August 10, 2009 and notified via postal mail or e-mail. If a winner does not respond to claim the prize within 10 days, the prize will be forfeited. Prizes will be delivered as determined by EatingWell, Cooking.com and Organic Valley at their discretion. To receive a list of winners, send a self-addressed, stamped envelope to above entry address by September 15, 2009.

Sweepstakes selection: Sweepstakes winners will be drawn randomly from the list of submitted entries. Winners will be selected by December 15, 2009 and notified via e-mail on or before December 20, 2009. If a winner does not respond to claim the prize within 10 days, the prize will be forfeited. Prizes will be delivered as determined by EatingWell, Cooking.com and Organic Valley at their discretion.

GENERAL: By entering this contest, all copyright rights of winning recipes belong to Eating Well, Inc. and to its content partners, Cooking.com and Organic Valley. Entry constitutes permission to use winner’s name, recipe, recipe name and any other information provided in the entry for editorial and promotional purposes by Eating Well, Inc., by Cooking.com (EatingWell's content partner), and by Organic Valley (EatingWell's content partner), except where prohibited by law. Information collected for this Contest is subject to EatingWell’s, Cooking.com's, and Organic Valley's privacy policies.

By entering, participants agree to release Eating Well, Inc., Cooking.com, Organic Valley, and contest partners, their respective agents and parent companies and each of their respective officers, directors and employees from any and all liability, loss, or damage arising out of participation in this promotion or with respect to awarding, receipt, possession, use and/or misuse of any prize.

When entering, participants may opt in to newsletters and special offers from Eating Well, Inc., newsletters and special offers from Cooking.com, and newsletters and special offers from Organic Valley. Participant names will be activated within thirty days of submission. Participants are not required to opt in and participants may opt out from Eating Well Inc., Cooking.com or Organic Valley newsletters and special offers at any time once they are activated.

GOVERNING LAW: All issues and questions regarding the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of entrants in connection with the Contest shall be governed by, and construed in accordance with, the laws of the State of Vermont . If this type of contest is prohibited by state or local law in your place of residence, do not enter the Contest.

All claims or disputes relating to the Contest shall be resolved in Chittenden County, Vermont, by mediation or in a court of competent jurisdiction.
